The following is an agreement between yourself (you) and My Agent™. By using this website ("the website") and accessing any of the contents contained in it, you agree to be bound by the following terms and conditions. Furthermore, THIS WEBSITE AND THE INFORMATION, SOFTWARE, AND SERVICES ARE PROVIDED 'AS IS' WITH NO EXPRESS OR IMPLIED WARRANTIES OF ANY KIND. My Agent™, OR ANY OF ITS AFFILIATES, IS NOT LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES OR ANY OTHER INJURY ARISING OUT OF THE USE OF THE SITE.

My Agent™ is not, nor claims to be, a government agency, is not affiliated with any government agency, and is not endorsed by any government agency.

The Site and its contents are copyright protected as of the date published. My Agent™ and its logo are trademarks of Timothy Burk, D.B.A. My Agent™, and reserves all rights to any and all copyrights, trademarks, or service marks located on the site. The business concept of My Agent™ is intellectual property and is owned solely by Timothy Burk.

Consumer Requests
When you submit information (an "inquiry") through this website, My Agent™ will submit your information to its affiliates or agents to locate a real estate agent. WE WILL NOT PROVIDE YOUR INFORMATION TO ANY THIRD-PARTY OR REAL ESTATE AGENT WITHOUT YOUR EXPRESS VERBAL OR WRITTEN PERMISSION (indicated by checking “Yes” to the question “Do you give My Agent™ and its affiliates permission to search for a real estate agent on your behalf and provide the agent with the information you provided above?”). The company, My Agent™, will assign your request to a real estate agent affiliated with My Agent™. If there is no agent in your desired location affiliated with My Agent™, the company reserves the right to refer your request to a referral real estate agent with a different company.  

Terms Applicable to Real Estate Agent Recommendations
Given the information you provide, both through the Site and verbal communication, My Agent™ and/or its affiliates will assign your information to real estate agents who may be able to meet your needs in helping you to purchase or sell a home. My Agent™ will make recommendations for real estate agents. These recommendations are just that - recommendations. You are not obligated to work with any real estate agent that is recommended. You agree that My Agent™ nor its affiliates will not be held responsible for service, advice, or any result due to any real estate agent recommended. You make the ultimate decision to hire any real estate agent. This Site and the contents provided are available in all fifty states in the U.S. and Washington, D.C. We will only provide recommendations for licensed real estate agents in the state you intend to purchase or sell a home.

Errors and Delays
My Agent™ is not responsible for any errors or delays in responding to your inquiry arising out of inaccurate information provided by you, or any other cause outside of our commercially reasonable control.

No Fees to the Consumer
There is no charge to you, as a consumer, for using the services provided on this Site. If you decide to work with the real estate agent who is recommended by My Agent™ and ultimately purchase a home using that agent, the agent will pay a referral fee to the representatives of My Agent™ and/or its affiliates.

Dispute Resolution
Any claim, dispute, or cause of action arising out of the use of the Site shall be subject to arbitration under the commercial arbitration rules of the American Arbitration Association, in a proceeding held before one arbitrator as chosen by My Agent™ The arbitration shall occur in Shelby County, AL. Any claim, dispute, or cause of action shall be resolved in the arbitration proceeding and shall be binding on all parties. You, as the consumer, waive and forfeit any and all rights to any action in state or federal court to defend or assert your rights.

Indemnity
You agree to indemnify My Agent™ and its' affiliates from and against any and all liabilities, expense (including attorney's fees) and damages arising out of any claims resulting from your use of this website, including without limitation any claims alleging facts that, if true, would constitute a breach by you of these Terms and Conditions of Use.

Other Terms - Complete Agreement and Choice of Law
This agreement between you and My Agent™ supersedes all communications, whether oral or written. To the extent allowable, this agreement shall be subject to the laws of the Alabama. All rights not expressly granted herein are reserved.
